Public Health Data Collection and Reporting in Massachusetts

In order to monitor the health of the general public, Massachusetts requires all health-care facilities to report incidences of certain diseases to the local health boards and the Department of Public Health.1 The law also mandates that all cancer cases2 and birth-related abnormalities3 be reported to the state’s registries.  Additionally, hospitals are required to report birth information4 and fetal deaths to the Commissioner of Public Health.5

The Department of Public Health can use any of the information it collects as part of its published annual reports regarding the health and welfare of the population or for research purposes.6  However, Massachusetts law requires that the Department and its employees maintain the confidentiality of all reported medical information, except in specific, limited circumstances.  More specifically, the law limits the use of individually identifiable data to the Department or local health board members, who have a specific need to see the personal health information.7
