The Department and local boards of health may obtain medical records and other information necessary to investigate, monitor, prevent the spread of disease from health care providers. School nurses are authorized to obtain immunization records from health care providers without authorization from the child’s parents or legal guardian in order to fulfill immunization requirements for entry into school. The school nurse must first try to get the immunization records from the parent or legal guardian, and inform them that if not provided, the record will be obtained from the child’s health care provider.
