A health insurer may not cancel, refuse to underwrite, or renew a particular policy based on an applicant or policyholder’s race, color, creed, sex, or blindness. A health insurer may underwrite a policy based on sex.
 
A health insurer may ask an applicant or enrollee about his or her race and ethnicity provided the information is used solely for the evaluation of quality of care outcomes and performance measurements.
