Idaho Code Ann. § 66-606, Powers of Agent

Authorizes the person designated as an agent in a patient’s mental health declaration to make decisions on behalf of the patient so long as the patient is incapable of making decisions and the agent makes the decisions in accordance with the terms of the declaration. Permits such agents to access medical records, consent to the disclosure of medical records, and receive treatment information unless otherwise limited by the terms of the declaration or federal law. Provides immunity to agents from criminal, civil, or professional actions that may arise from their actions so long at they acted in good faith and in accordance with the terms of the declaration. Clarifies that agents are not personally responsible for treatment costs.
