Idaho Code Ann. § 39-1392d, Property of Health Care Organization

Declares peer review records to be the property of the health care organization that obtains or compiles the record. Permits health care organizations to give their peer review records to entities that perform quality assurance, certification, evaluation, or accreditation activities. Clarifies that the sharing of records to such entities does not waive the peer review privilege of these records. Requires persons that receive peer review records for such purposes to maintain the confidentiality of the records and prohibits the subpoena of such persons.
