Idaho Admin. Code r. 16.05.01.102, Victim of Other Crime

Permits the Department of Health and Welfare to disclose information about victims of crimes other than abuse, neglect, or domestic violence if the victim of the crime consents. Permits disclosure when the individual cannot consent because they are incapacitated or an emergency situation exists if the law enforcement official declares that the information is necessary to determine whether the law was violated, that the information will not be used against the individual, and that waiting for the victim’s consent would adversely impact law enforcement activity. Requires the professional staff to then determine that disclosure is in the best interests of the individual.
