Idaho Admin. Code r. 16.03.09.235, Patient Advance Directives

Requires specified providers (e.g., hospitals, nursing facilities, home health care services, etc.) to provide adult patients with information regarding their legal rights to make medical decisions. Requires providers to inform patients of their right to execute an advance directive and give them information on the provider’s policies for following patient advance directives. Requires providers to either document whether a patient has executed an advance directive in the patients medical record or—if the patient has executed the Department of Health and Welfare’s advanced directive form—make a copy of this form part of the medical record. Requires providers that cannot comply with a patient’s advance directive to transfer them to another provider that is able to comply.
