Requires long-term care facility residents—or their legal representative— to consent in writing to ombudsman access of their confidential records. Permits the ombudsman to access records without consent if consent was denied by the resident’s legal representative, the ombudsman believes the representative is not acting in the best interests of the resident, and the Office of the State Ombudsman for the Elderly approves of the access.
