This law allows a court to order the release of a patient’s mental health record in an investigation or legal proceeding without the patient’s consent, if at the end of the hearing, the court finds that over 50% of the evidence points to the fact that:
- There are no other reasonable methods of getting the information, or
- That the need for disclosure is more than the harm that the disclosure would cause the patient
