Unprofessional Conduct

The following actions constitute unprofessional conduct by a licensed physician or surgeon:

  • Failing to make available promptly to a patient, the patient's representative, or succeeding health care professionals or institutions copies of those patient records in the possession or under the control of the licensed practitioner when given proper written request and direction of the person using professional health care services;
  • Providing, prescribing, or dispensing medical services or items in response to any communication transmitted or received by computer or other electronic means, when the licensee fails to make a reasonable effort to verify that the person requesting medication is in fact the patient, fails to establish a documented diagnosis through the use of accepted medical practices, and/or fails to maintain a current medical record;
  • Failing to provide to the board such information it may reasonably request; or
  • Engaing in disruptive behavior that involves interaction with physicians, hospital personnel, office staff, patients, or support persons of the patient or others that interferes with patient care or could reasonably be expected to adversely affect the quality of care rendered to a patient.
