A patient or his or her legally authorized representative may submit a written authorization to examine or copy all or part of the patient's recorded health care information. As promptly as required under the circumstances, but no later than 15 business days after receiving such authorization, a hospital or its agent must either make the information available as requested, or inform the requestor that the information does not exist or cannot be found.

The hospital or its agent may charge a reasonable fee for providing the information and may withhold access to the information until the fee is paid, unless there is a medical emergency. This fee may include a basic retrieval or processing fee, including a fee for copying pages 1-10, of up to $30 (up to $45 for records stored on microform), a copying fee of up to $1 per page for pages 11-60, up to $0.50 for pages 61-400, and up to $0.25 per page for pages 401 and above, and the actual cost of mailing, shipping, or otherwise delivering the provided copies. If the requested records are provided on a digital or other electronic medium, and the requesting party requests delivery in a digital or electronic media, the hospital or its agent may charge a retrieval or processing fee of up to $75 and the actual cost of mailing, shipping, or otherwise delivering the provided copies. 

A hospital may not charge a fee if the records were requested in connection with an application for benefits or assistance related to a person's disability or with an appeal for a denial of such benefits or assistance, or if the records relate to treatment or hospitalization for which workers compensation is sought. A hospital may not charge a fee to a person to examine his or her own health care information
