Providers must maintain a patient’s x-ray film for at least 5 years.  At the time the x-ray is taken, the provider must either inform the patient in writing, or post a conspicuous sign, that informs patients that the x-ray will be kept on file and that the provider will provide a copy of the film at the actual cost to the provider.

A provider is immune from civil liability for destroying or failing to maintain the x-ray if the destruction or failure is not done in bad faith.  This does not prevent the imposition of disciplinary sanctions against the provider.
