Requirements for Ability to Make Health Care Decisions – Ind. Code Ann.§ 16-36-1-4

An individual may consent to health care or treatment unless the health care provider finds that the person is incapable of making a health care decision.  Consent that has been provided is not valid if the provider has knowledge of contrary instructions regarding the proposed care.
