Physicians, prior to performing an abortion, must (1) inform the woman that she is pregnant and estimate the current age of the fetus; (2) explain the medical nature of the abortion and estimate the age of the fetus at the time of the abortion; (3) explain the medical procedure that will be used to perform the abortion; and (4) explain the risks associated with the medical procedure that will be used to perform the abortion. A physician may choose not to disclose a risk if they determine that disclosure should not or need not be made and document the medical reason for non-disclosure in the woman’s medical record. Physicians may choose to provide women with additional facts or disclosures that they believe reasonably necessary, in their “best medical judgment,” to enable informed consent.
