Practitioners Required to Create and Maintain a Health Record – Ind. Code Ann.§ 16-39-7-1

Health care providers must maintain the original health records or microfilms of the records for at least 7 years.  Providers who violate this requirement commit an offense for which a board may impose disciplinary sanctions against the provider. However, a provider is immune from civil liability for destroying or failing to maintain the record if the destruction or failure occurred in connection with a disaster emergency as declared by the governor or other disaster (unless the destruction or failure was due to negligence by the provider).

Providers that are subject to these requirements include:

  • Physicians
  • Dentists
  • Registered nurses
  • Licensed practical nurses
  • Optometrists
  • Podiatrists
  • Chiropractors
  • Physical therapists
  • Psychologists
  • Audiologists
  • Speech-language pathologists
  • Home health agencies
  • Hospitals
