Any health facility or freestanding ambulatory surgical clinic that fails to report financial, health facilities or utilization data as required by Health & Safety Code §128736 to Health & Safety Code §128766 is subject to a fine of $100 per day that the report is delayed. Any health facility that does not use an approved accounting system pursuant to the chapter is subject to a penalty not to exceed $5,000.
