Persons that violate the Rhode Island Health Information Act of 2008 may be civilly liable for actual and exemplary damages while persons that knowingly and intentionally violate the Act may be criminally liable for $10,000 and/or 1 year imprisonment per violation. Persons that violate the Act while committing a criminal offense may be held civilly and criminally liable for their violations. A court presiding over a case involving an Act violation may award attorney’s fees to the prevailing party.
