Residents of nursing homes are guaranteed several rights, including the following:

  • To be fully informed by a physician of the medical condition of the resident, unless medically contraindicated;
  • To be given the opportunity to participate in planning medical treatment and to refuse experimental research;
  • To be assured that medical and personal records are kept confidential;
  • To be assured that medical and personal records are not released outside the facility unless the resident is transferred, examination of the records is required by the third party payment contractor or the resident otherwise authorizes disclosure;
