The Long Term Care Ombudsman and his designees may access any long term care resident’s records with the written authorization of the resident or his legal guardian.  If the resident is unable to consent and has no legal guardian, the Office of the Long Term Care Ombudsman may subpoena the resident’s records for the purposes of complaint investigation and resolution.  The Ombudsman and his designees will also have access to long term care facility records that relate to an investigation, including incident reports and survey inspection reports.
