Mich. Comp. Laws Ann. § 333.7333a - Electronic monitoring system

The department of community health must create an electronic system to monitor the dispensing of “schedule 2, 3, 4, and 5 controlled substances” by pharmacists, veterinarians, and other licensed individuals. The data contained in this system will include items such as the patient identifiers and the dispensed substance.

The director of the department of community health may disclose the information contained in the electronic system, unless protected by a practitioner-patient privilege, to licensing boards, department employees, law enforcement agencies, state Medicaid programs, a government official that has a subpoena for the information, or a practitioner that needs the information to provide treatment to the patient.

The electronic system may only be used for drug enforcement, licensing, and disciplinary purposes. Individuals that obtain identifying information from the system must keep the information confidential unless ordered to disclose by a court. System information is not subject to the freedom of information act.
