All nursing homes must annually certify to the department that every phase of its operation is without discrimination against any persons on the basis of race, religion, color, national origin, sex, age, disability, marital status, sexual preference, or the exercise of rights that are guaranteed by law. However, this Section does not prohibit those nursing homes operated by a religious or fraternal institution from giving preference to those applicants who are members of those organizations.
