Kan. Stat. Ann. § 65-6018, HIV screening for pregnant women and newborn children

Requires health care providers to test pregnant persons for HIV during their first trimester of pregnancy and either during their third trimester or at the time of labor and delivery. Requires pregnant persons whose HIV status is unknown at the time of labor and delivery to undergo HIV testing as soon as possible. Requires providers that test for HIV with a rapid test kit to submit a confirmatory sample for serological testing. Requires pregnant persons to give their informed consent prior to undergoing HIV testing and permits them to opt-out of the testing. Requires newborn infants to be tested for HIV if their birth parent’s HIV status is unknown. Permits such screening to occur without parental or guardian consent unless the parent(s) or guardian(s) object on religious grounds. Requires providers to document the birth parent’s HIV status in their medical record and the infant’s medical record.
