Permits nursing facility residents to be prescribed psychotropic medications only if the resident gives their informed consent, the reason for using the medication is documented in the resident’s record, and the facility has a system in place to monitor the impact of the medication on the resident. Prohibits use of seclusion in nursing facilities, but permits use of restraints so long as they are necessary to prevent substantial harm, are ordered by a physician, and applied with the informed consent of the resident or their guardian. Requires facilities to monitor the restrained resident and document specified information (e.g., release of the resident for exercise, fluid intake, etc.).
