Establishes administrative standards for nursing facilities that address items such as the governing body, staffing, designation of a medical director, transfer agreements, quality assurance activities, and the maintenance of confidential clinical records. Specifies the information that facilities must include in clinical records and establishes retention periods. Permits disclosure of resident’s confidential information only: when required by law, while transferring the resident to another health care facility, for payment purposes, to the resident or their guardian, or to a deceased resident’s executor, spouse, or adult family member. Requires nursing facilities to store clinical records in a manner that protects them from physical destruction, loss, or unauthorized access.
