Kan. Admin. Regs. § 28-39-150, Resident behavior and nursing facility practices

Permits the use of physical or pharmacologic restraints on nursing facility residents if they are applied pursuant to a physician’s written order, are removed at least once every two hours, and the resident is monitored while under restraint. Requires the use of restraints to be justified in the resident’s clinical record. Permits use of restraints without a physician’s order if they are necessary to prevent the resident from causing harm to themselves or others. Requires such emergency uses to receive physician approval within 12 hours.  Requires nursing facilities to have policies and procedures for preventing resident abuse, neglect, and exploitation and identifies the elements these policies and procedures must include (e.g., reporting of incidents, records of investigations, etc.).
