Ind. Code Ann. § 16-39-3-7 - Release of mental health records in investigations and legal proceedings

This law allows a court to order the release of a patient’s mental health record in an investigation or legal proceeding without the patient’s consent, if at the end of the hearing, the court finds that over 50% of the evidence points to the fact that:

  • There are no other reasonable methods of getting the information, or
  • That the need for disclosure is more than the harm that the disclosure would cause the patient
