Florida Statutes § 641.31073

“Prohibiting discrimination against individual participants and beneficiaries based on health status under the Health Maintenance Organization Act”

A group health maintenance organization may not base its rules for eligibility on the following health status related factors:

  • Health status;
  • Medical condition;
  • Claims experience;
  • Receipt of health care;
  • Medical history;
  • Genetic information;
  • Evidence of insurability, including conditions arising out of acts of domestic violence; and
  • Disability.
