“Disciplinary grounds and actions under the regulation of professions and occupations law”

Respiratory therapists may be denied a license or face disciplinary sanctions for a variety of grounds including:

  • Filing a false report or failing to file a report required by state or federal law;
  • Unprofessional conduct which includes the failure to conform to acceptable standards related to the delivery of respiratory care services;
  • Medical malpractice;
  • Paying or receiving any commission, bonus, kickback, or rebate or engaging in a split-fee arrangement with a health care provider for patient referrals;
  • Failing to keep written patient records; and
  • Being unable to practice respiratory care because of illness or substance use.
