“Confidentiality of health information related to sexually transmitted diseases under the Control of Sexually Transmissible Disease Act”

All information and records held by the Department of Health relating to known or suspected cases of sexually transmissible diseases are strictly confidential and may not be disclosed to the public or to a court except:

  • When made with the consent of all persons to which the information applies;
  • For research purposes; 
  • To medical personnel, during a medical emergency,
  • To a court if the disclosure is deemed necessary by the court to reach a decision unless otherwise agreed to by all parties.

No employee of the Department of Health may testify, without the consent of the person examined and treated for such diseases, on a person’s records.
