“Rebates prohibited; penalties under the public health law”

A nursing home is prohibited from paying or receiving any commission, bonus, kickback, or rebate or engaging in any split-fee arrangement with any health care provider for resident referrals. A nursing home that violates this statute may be fined up to $5,000 and be subject to disciplinary sanctions.
