Patient records; Costs of Reproduction; Timely Release
Any osteopathic physician who treats a patient must provide a copy of the medical record to the patient upon written request. The physician must provide the record in a timely manner, which means not more than 30 days when there are no extenuating circumstances. The provision of copies of the medical record may not be conditioned on the payment of an unpaid or disputed fee for services rendered, but may be conditioned on the payment of reasonable copying costs.
The rule defines reasonable copying costs to be no more than $1 per page for the first 25 pages, and no more than $.25 per page for each page thereafter. Reasonable fees for copying x-rays and other special records are the actual copying costs, which include the actual materials and supplies to copy and the labor costs.
