Disclosure of medical assistance information – Ohio Rev. Code Ann. § 5160.45

Information regarding a medical assistance recipient may only be disclosed in connection with the administration of the medical assistance program.  The department of job and family services or a county agency may disclose information regarding a medical assistance recipient to the following:

  • The recipient or his authorized representative;
  • The recipient’s legal guardian, in accordance with relevant provisions;
  • The attorney of the recipient, if sufficient authorization has been provided by the recipient, his authorized representative, or his legal guardians;
  • A health information or health records management with a business associate agreement with the department, if disclosure of the recipient’s electronic health records has been authorized by the recipient, his authorized representative, or his legal guardian; and
  • A court, pursuant to a court order.

The department may receive from county departments information regarding any medical assistance recipient for purposes of training and verifying the accuracy of eligibility determinations of medical assistance.  Information received and assembled into a report will remain confidential and is not subject to disclosure.
