Del. Code Ann. tit. 16, § 1212 - Disclosure of protected health information

The Department of Health and Social Services may not disclose an individual’s health information without the informed consent of the individual or the individual’s representative. Any disclosures of an individual’s health information must be disclosed in a nonidentifiable form whenever possible except when the disclosure is authorized by the person who is subject to the information. However, some of the individuals’ health information may be disclosed without informed consent to the following parties: directly to the individual; to federal agencies or authorities for law enforcement purposes; to emergency healthcare personnel to protect the health or life of the person who is the subject of the information from serious, imminent harm; to the public safety authority during a public health emergency; to a court pursuant to a court order; to the Child Death, Near Death and Still Birth Commission; to researchers provided that they provide documentation that they will protect the confidentiality of the information they receive; to health care providers for patient treatment and care coordination; or to a health plan, health care clearinghouse, business associate, or health care provider.
