Information and reports obtained while administering New York’s HIV laws must be kept confidential. However, disclosure is permissible (1) if otherwise authorized by law; (2) if the information released is in the aggregate, lacks patient identifying information, and is used for programs aimed at improving the quality of HIV/AIDs care; or (3) if it occurs within state or local departments of health for the purpose of “assess[ing] comorbidity,” the “completeness of reporting,” or program needs and the applicable department ensures that patient identifying information remains within the department.
