Confidential information

 

The collection, compilation, analysis, and dissemination of information by the office of the state long-term care ombudsman program must protect confidential records of residents or recipients.  The identity of a resident or recipient, complainant, or individual providing information about a complaint may not be disclosed without that individual’s written consent, his legal representative, or as is required by court order. 

 

The investigative files of the office are not public records.  Information contained in investigative and other files maintained by ombudsman programs may only be disclosed at the discretion of the individual or program maintaining the records or if disclosure is required by court order.

 

No report prepared by the state ombudsman or a regional program may include any information that violates these confidentiality requirements.
