243. Mass. Code Regs. 3.08. - Qualified Patient Care Assessment Program - Major Incident Reporting to the Board of Registration in Medicine

All health care facilities and medical staff must report the following major accidents to the Board of Medicine:

  • Maternal deaths related to delivery;
  • Death from ambulatory procedures;
  • Invasive diagnostic procedure or surgery performed on the wrong body part;
  • Deaths or permanent impairments not in the ordinary course of a condition.

The first three accident types must be reported under all circumstances, while the fourth type is an extremely unusual circumstance and may not have been preventable.  Health care facilities must file reports quarterly with the Board.  The initial reports are not required to individually name the health care provider involved with the incident, however, the name must be provided if requested by the Board.
