16 Del. Code § 2006 - Confidentiality and access to data

The collection, compilation, data analysis, and dissemination of reports must be done in a way that protects patient privacy.  The state agency (defined as the Division of Public Health) must maintain the confidentiality of patient identifiable information.  Raw data is not a public record and may not be made available for public inspection. 

All compilations prepared by the state agency for dissemination are considered public records and must be accessible by the public.
