Health benefit exchange-creation

The state of Colorado has created a nonprofit public entity known as the health benefit exchange governed by a Board of Directors.  The Board is responsible for the governance, development and operation of the Exchange.  The Exchange may not replicate or replace the duties of the Insurance Commissioner, such as rate approval, unless directed by the federal Affordable Care Act.  The Exchange must foster competition, but not engage in active purchasing among insurance carriers.  All insurance carriers authorized to conduct business in the state may participate in the Exchange.
