The Affordable Care Act's Transparency Requirements

The Affordable Care Act included the Physician Payment Sunshine Act, requiring certain drug companies and medical device manufacturers to annually report payments made to physicians in return for services related to developing or modifying drugs or devices, such as participation in clinical trials and consulting arrangements. In addition, certain entities must annually report information about a physician or a physician's immediate family member's ownership in the entity. A blog post on the ACA's transparency requirements is available on-line here from the Commonwealth Fund. CMS finalized regulations for the Sunshine Act on February 8, 2013, which became effective on April 9, 2013.

An overview of the Final Rule and key issues related to these provisions is available as a PDF below in a brief by Jane Hyatt Thorpe and Teresa Cascio,  published on Health Reform GPS
