Health care provider filing charges or presenting evidence — Immunity — Information sharing.

Health care providers that submit information, in good faith, to a peer review committee or board are immune from any resulting civil liability. Washington presumes that health care providers will submit information in good faith, but a party may introduce evidence to challenge this presumption.

All records and information held by peer review committees is confidential and may only be obtained by subpoena or discovery if a health care provider’s clinical or staff privileges are at issue.

Coordinated quality improvement programs. quality assurance committees, peer review boards, and peer review committees may share information with other quality improvement programs, quality assurance committees, peer review boards, and peer review committees in order to improve quality of care and prevent malpractice. Boards and committees that exchange information must comply with HIPPA’s privacy requirements and Washington’s confidentiality laws. All information exchanged by boards and committees is not subject to discovery.
