“Records to be kept; confidentiality under the Controlled Drug Act”

(I) Practitioners must keep separate records showing the disposition of all controlled drugs in order to protect confidentiality of patient records. Practitioners includes physicians, podiatrists, dentists, veterinarians, optometrists, advanced practice registered nurses, manufacturers, wholesalers, pharmacists, clinics, hospitals, and laboratories.

(IV) Records that contain prescription information that identifies patients and prescribers must not be disclosed to third parties for any commercial purposes except for pharmacy reimbursement, formulary compliance, care management, utilization review, the patient’s insurance provider, health care research, or for any other purpose permitted by law. Commercial purpose includes advertising, marketing, promotion, or any activity that could be used to influence sales.
