A provider may disclose relevant medical information to a patient’s family member, spouse, or relative, if that person is directly involved in the patient’s care or payment. A provider may disclose relevant medical information to notify a family member of the patient’s location, condition, and/or death. If the patient is available, the provider can disclose medical information as long as it gets the patient’s consent, allows the patient to object to the disclosure, and he does not; or if the patient is not present or is incapacitated, if disclosure is in the best interest of the patient.
