Provider Recordkeeping and Data Collection
Requires providers of DD waiver services to collect any data, records, and information they need to provide services and to implement a record keeping system to house participant records. Requires providers to securely maintain records for at least six years following the end of the fiscal year during which they provided services. Requires the participant or the participant’s authorized representative to authorize disclosure of their identifying information unless disclosure without authorization is otherwise permitted by law. Authorizes the Department and other appropriate federal or state government representatives to access provider records.
