Protocol for the Management for Infectious Forms of Tuberculosis – N.M. Stat. Ann. §24-1-15.1

When a physician gains knowledge that an individual is infected with an infectious form of tuberculosis, the physician must inform the Department of Health.  The Department must prescribe a treatment plan for the infected individual.  If, however, the individual fails to comply with the Department’s treatment plan, the Department may petition the court to order the individual to comply with the course of action recommended by the Department, including directly observed therapy, isolation, or both.  The petition must specifically state the individual has an active infection of tuberculosis, and has refused to comply with treatment.  The court may grant an ex parte order calling for immediate directed observation or observation or order a temporary protective order.
