Prohibited acts and criminal penalties - 6 Pa. Code § 22.72

The following acts are considered criminal offenses, and will result in a financial penalty of three times the value of any material gain received as a result of the offense:

  • Submitting a false or fraudulent claim or application to the Pennsylvania Pharmaceutical Assistance Contract for the Elderly (PACE) program;
  • Aiding or abetting another in submitting a false or fraudulent claim or application to the PACE program;
  • Receiving benefits or reimbursement under a private, state or federal program for prescription assistance and claiming or receiving duplicative benefits from the PACE program;
  • Soliciting, receiving, offering or paying a kickback, bribe or rebate in connection with the furnishing of services under the PACE program.
