New Mexico’s Patient Protection Act requires all managed care plans to have an adequately staffed consumer assistance office to respond to consumers’ questions and concerns.  Each plan must also establish a Consumer Advisory Board to give the plan enrollees’ perspectives on general operations. 

Any person who has been negatively affected may file a complaint with the Superintendent of Insurance based on a violation of the Patient Protection Act.   The Superintendent may hold a hearing to make determinations about the violation.
