N.J.S.A. § 26:2H-18.55 - Duties of Commissioner

The Commissioner of Health must:

  • Administer funds and allocate monies received from the Commissioner of Labor;
  • Determine eligibility and claims pricing systems for the charity care component of the disproportionate share subsidy, and develop uniform forms for eligibility and submitting claims;
  • Establish a schedule of payments for reimbursement of the charity care component of the disproportionate share payment for services provided to emergency room patients who are not emergency cases;
  • Develop and provide for the implementation of the Health Access New Jersey program with the Department of Insurance;
  • Study and establish hospital cost and outcome reports to provide assistance to consumers in the state;
  • Compile demographic information on recipients of, and types of services paid for by the charity care component of the disproportionate share payment and report these findings to the Governor and Legislature. The demographic information must include, the recipient's age, sex, marital status, employment status, and type of health insurance coverage, if any. If the recipient is under 18 years of age who does not have health insurance coverage or a married person who does not have health insurance coverage, the information must also include whether the child's parent or the married person's spouse has health insurance;
  • Encourage the use of a centralized data storage system and transmission technology;
  • Take any other actions deemed to be necessary.
