“Confidentiality and disclosure of test results under the Insurance Department regulations”

All information in possession of an insurer regarding any HIV test is confidential.  Each insurer must maintain data enabling it to report the number of applicants who submitted to HIV tests and the number of applicants denied insurance as a result of the test result.  The information must be made available to the insurance commissioner upon request.  In the event of a positive test result, an insurer must disclose the positive test results only to the individual tested or to another person authorized in the approved consent form by the individual tested.
