“Personal rights under the division of mental health and developmental services regulations”

Clients of state mental health facilities have the following rights:  

  • To be treated with dignity and respect at all times;
  • To be free from abuse, neglect, and exploitation including, at a minimum, the following;
  • The right to privacy;
  • The right to confidentiality of all information and records;
  • Access to records;
  • The right to complain about any alleged violation of a right afforded to a client;
  • The right to freely and privately communicate with others;
  • The right to be free from searches of their persons and possessions except where reasonably necessary for the protection of the safety of the client or others, to prevent the introduction of contraband, and pursuant to a search warrant;
  • The right to individual choice; and
  • The right not to work and to be compensated for any work performed.
