Medicaid fraud; defined; investigation; penalties-N.M. Stat. Ann. § 30-44-7

Medicaid fraud includes paying, soliciting, offering, or receiving kickbacks or bribes, rebates of referral fees, and anything of value that is in excess of amounts authorized under the program, among other prohibitions. Anyone committing Medicaid fraud in this section is guilty of a fourth degree felony and subject to sentencing and fines. If the Medicaid fraud results in the death of an individual, the party is guilty of a second-degree felony and subject to sentencing. If the party committing Medicaid fraud is an entity, it is subject to a fine of up to $50,000 for each misdemeanor and no more than $250,000 for each felony.
